This Driver Service Agreement (“Agreement”) governs the relationship between Kyrenia Global Holdings LLC, the owner and operator of the PinkDrive technology platform (“PinkDrive”, “we”, “our” or “us”) and every independent driver approved to use the PinkDrive platform to connect with passengers (“Driver”, “you” or “your”).
By creating a driver account, submitting your documents, or accepting ride requests through the PinkDrive platform, you agree to be legally bound by this Agreement.
Drivers using the PinkDrive platform to provide transportation services to passengers are independent contractors.
PinkDrive operates a technology platform that enables passengers and independent drivers to connect. PinkDrive does not provide transportation services and is not a transportation carrier.
Nothing in this Agreement creates an employment, partnership, joint venture or agency relationship between PinkDrive and any Driver.
Drivers are solely responsible for providing transportation services, complying with all applicable laws, maintaining required licences and insurance, paying taxes and operating their independent business.
To become a PinkDrive Driver you must:
PinkDrive may refuse or remove any Driver at its discretion where permitted by law.
Drivers must provide accurate information including:
PinkDrive uses Didit Identity, Inc. (“Didit”), an identity-verification provider acting on PinkDrive’s behalf, to assist with driver identity and safety verification.
As part of verification, Didit may process your government-issued identity document, selfie or facial image, liveness information and biometric data generated for facial matching and identity verification. This information is used to confirm your identity, help prevent fraud and protect the safety and integrity of the PinkDrive platform.
Identity-verification information may be processed or transferred outside Morocco through Didit and its authorised infrastructure and service providers. Where required by applicable law, PinkDrive obtains your explicit consent for the relevant identity, biometric and international-transfer processing.
Identity-verification images and biometric verification data processed for PinkDrive through Didit are retained for seven (7) days after verification approval and are then deleted, unless a longer retention period is required by applicable law.

PinkDrive provides only the technology platform that enables Drivers and passengers to connect. PinkDrive does not direct, supervise or control the manner in which Drivers provide transportation services, except where necessary to operate, protect or improve the platform or comply with applicable law.
Where payment processing is offered through the platform, PinkDrive may facilitate the collection and distribution of payments on behalf of Drivers.
Drivers receive payment in accordance with the applicable payment schedule after deduction of any agreed platform commission, fees or charges.
Payment methods and commission rates may be updated from time to time.
Drivers are responsible for:

Failure to maintain valid insurance may result in immediate suspension.
Drivers are solely responsible for ensuring that their insurance remains valid and adequate for the services they provide.

PinkDrive may suspend or permanently terminate Driver accounts for:
Drivers must protect confidential information obtained through the platform including passenger information, pricing information and operational information.
The PinkDrive name, logo, software, website, applications, trademarks and related intellectual property remain the exclusive property of Kyrenia Global Holdings LLC, its subsidiaries, affiliates and licensors.
Drivers receive only a limited licence to use the PinkDrive platform while authorised.
PinkDrive may update this Agreement from time to time.
Continued use of the PinkDrive platform after updated terms become effective constitutes acceptance of those changes.
This Agreement shall be governed by the laws applicable in the jurisdiction in which the Driver provides transportation services, together with any mandatory laws applicable to the operation of the PinkDrive platform.
Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Morocco unless otherwise required by applicable law.
